DCAA’s Operations Investigative Support Division (OIS) recently supported an investigation resulting in a $300,000 civil settlement with LED Lighting Solutions, LLC (LED Lighting Solutions) and its owner, Thomas DeSantos. The United States alleged LED Lighting Solutions violated the Buy American Act (BAA), the Trade Agreements Act (TAA) and the False Claims Act by selling foreign end products to government agencies. LED Lighting Solutions entered a Multiple Award Schedule contract with the General Service Administration (GSA) in 2013. Additionally, LED Lighting Solutions entered into eight contracts and delivery orders with the Air Force, Army and Federal Emergency Management Agency (FEMA) that required BAA compliance.
The United States alleged that LED Lighting Solutions falsely certified using domestic end products and compliance under multiple contracts and delivery orders, when in fact they provided products manufactured in foreign countries, including those not entered into a trade agreement with the United States.
The OIS team provided critical auditing expertise analyzing contracts, delivery orders and certifications to uncover discrepancies and support the case. The team worked alongside other investigative agencies including the GSA Office of Inspector General, the Department of the Army Criminal Investigative Division, the U.S. Coast Guard, the Air Force Office of Special Investigations, the Federal Bureau of Investigation and Department of Justice Office of Inspector General.
